These Terms of Use (“Terms”) govern your access to and use of the Dewfall Studios website at https://dewfallstudios.com (the “Site”). By using the Site you agree to these Terms. If you don't agree, please don't use the Site.

This is a marketing website. It describes what we do and lets you contact us. Our actual products — web development, email, payments, shortlinks and SMS — are provided under separate agreements with their own sign-up and their own terms. Nothing on this Site is a contract to provide any product or service; using a product is governed by the terms you accept when you sign up for it.

Using the Site

You agree to use the Site lawfully and not to:

• attempt to disrupt, overload, probe or gain unauthorized access to the Site or its infrastructure;
• scrape, copy or republish Site content except as permitted below;
• misuse the contact form — for example to send spam, malware or unlawful content; or
• use the Site in any way that breaches applicable law or the rights of others.

Contacting us

The contact form opens a message in your own email app for you to send to us. Sending an enquiry doesn't create any business relationship or obligation on either side — it's simply the start of a conversation. Please don't send us confidential or sensitive information through it. How we handle the details you send is described in our Privacy Policy.

Intellectual property

The Site and its content — including text, design, graphics, logos and the Dewfall Studios name and marks — are owned by us or our licensors and are protected by intellectual property laws. You may view and share the Site for ordinary, non-commercial purposes, but you may not copy, modify, distribute or use it commercially without our prior written permission.

Third-party links

The Site may link to third-party websites or services. We don't control those and aren't responsible for their content, products or practices. Following such links is at your own risk and subject to the third party's own terms.

No warranties

The Site is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We don't guarantee that the Site will be uninterrupted, error-free or secure, or that the information on it is complete or current. Product descriptions and pricing shown here are for general information and may change.

Limitation of liability

To the fullest extent permitted by law, Dewfall Studios will not be liable for any indirect, incidental, special or consequential damages, or any loss of data, revenue or profits, arising out of your use of (or inability to use) the Site. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Changes

We may update the Site and these Terms from time to time. When we change these Terms we'll revise the “Last updated” date in the header above, and continued use of the Site means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute relating to the Site, without affecting any mandatory consumer rights you may have where you live.
